The Plaintiff, a French national and a resident of France, purchased a car from the defendant, a Saudi car dealer with the Saudi nationality, who is a resident of France.

The sale contract was discussed and signed between the parties in France where the defendant told the Plaintiff that the car was made by Mercedes. Upon on the delivery of the car and after the payment has been transferred to the French Bank, the plaintiff discovered that the car was not Mercedes, but another Chinese company.

Plaintiff wants to start a law suit for rescission of the contract while the defendant was on a visit to Egypt where the defendant has purchased an apartment in Egypt and started his car dealership business in Cairo.

The Plaintiff has come to you as an expert in Private International Law and asked your expert advice based on your understanding of private international law on what is the best jurisdiction to bring the law suite/file a claim.

a) What would you advice the Plaintiff on what is the best jurisdiction to start the law suit and why? (Provide your analysis on the best place to bring the legal action and what factors you should consider in bringing the law suit)

d) If the Saudi car dealer has purchased the car from a Pakistani car dealer in Saudi Arabia who told the Saudi buyer that the car was Mercedes. The Pakistani car dealer resides in Saudi Arabia, but he went to Pakistan for a short family visit. Where would you advice the Saudi car dealer to bring a Law Suit and what Article/law is the basis of your answer?
