Chapter 8 Discussion Forum In AMJ Campbell v. Kord Products Inc., the placement of a comma cost the plaintiffs $759,000 because they (and their lawyers) failed to do their due diligence. The plaintiffs tried to claim mistake and asked the court to rectify the contract by removing the comma but the court refused. This case highlights the fact that not only is the language in a contract important but so is the punctuation used! In this discussion forum, the task for this post is to share with the class how a particular clause in a contract should make you hesitate to agree to be bound by its terms. In order to find a contract worth discussing for this post, you may look up sample contracts online or use a contract to which you are actually a party. Remember, you are only selecting one clause from the contract to discuss. A good example of a type of contract to which we all click "accept" is the terms of use for public Wi-fi. If you have been to a mall, Tim Hortons, Starbucks or anywhere else that has a security recommendation before accessing free Wi-fi, then you have been a party to a type of terms of use contract. I use the BC Ferries wireless network frequently and, each time, I am surprised to see that their terms of use contract is 3 pages long! The point to make here is that many of us agree to terms without actually reading them carefully. So, your task for this discussion forum is to post an example of a clause in a contract that would make you think twice before agreeing to its terms (even though the reality is that you have already agreed to all the terms by clicking "accept"). Make sure to discuss why you chose the clause and what about the clause is surprising/unexpected/alarming to you. Many of you will be shocked by what you have agreed to by accepting the terms of user agreements for the social media accounts you have created. Remember, you can either share by posting your own example or you can comment on another student's post by elaborating on and adding to their content. If you choose to write about a contract that you have researched, then make sure to pick one that has found its way into the courts. I have already mentioned AMJ Campbell v. Kord Products Inc. (which is often called the case of the "$1-million Comma") and there is another Canadian case that is referred to as the case of the "$2-million Comma". If you write about a contract case, then make sure to mention the exact clause that caused legal problems and explain why the clause was problematic
