Please read pgs. 488 - 504. You do NOT have to read the cases within the chapter. HOWEVER, I encourage you to utilize the trial of Zacarias Moussaoui examples that are there for you.

8. Read the Background and the facts portion of the hypothetical case (People v. Stuart), located for you in Appendix II on pgs. 539-544. Make sure you thoroughly understand what you are reading, as all of your assignments are based around this mock trial case. PLEASE NOTE - in completing your assignments, assume that YOU ARE WORKING FOR A FIRM THAT REPRESENTS MARY.

For Assignments a - d, please answer them on ONE Word Document. Please number your answers accordingly, but just upload one document.

a. Formulate 5 Voire Dire Questions. These questions cannot be background questions (age,occupation, etc....) these questions need to go to the heart of the case. When thinking about what kind of questions to ask, think about questions that would help you to eliminate jurors who would not be in favor of our client, Mary. (5 points)

b. Please answer the following questions:

i. Who has the burden of proof in our case? (1 point)

ii. What is the burden of proof that they must meet? (1 point)

c. List three types/kind of evidence that you would want the jury to see/hear in our defense of Mary and explain WHY. (6 points)

d. On page 542, it lists the potential witnesses in our case. Choose two of those witnesses and type out 5 non-background questions that you would want to ask them in trial that would be favorable to our client, Mary. (10 points)
