In Allied Maples v Simmons & Simmonds [1995] 4 All ER 907 the court allowed Allied Maples Group (AMG) to recover damages from its solicitors Simmons & Simmons (S&S) for the latters failure to advise AMG of certain potential liabilities arising under leases forming part of the transaction. No warranty against such liabilities were obtained by S&S and when the transaction was completed, AMG was liable for substantial sums. It successfully brought an action to recover damages from S&S for their negligent advice.
