Directive 2004/38Michelle is a French national who moves to Luxembourg. She stays in temporary accommodation and after a couple of months her funds run out as most of her income is spend fuelling her drug addiction. Michelle decides to turn her life around and goes to 'Second Chance', an NGO helping former addicts to rehabilitate by working in an urban farm. They offer Michelle a place in their program, and she takes up work with them, helping around at the farm, cleaning and organising tours of farm for visitors. In exchange for her work, which takes up 25 hours per week, Michelle benefits from bed and board in one of the Second Life hostels and receives pocket money. Michelle applies for a minimum income basic welfare in Luxembourg to be able to rebuild her life and live independently. Luxembourg authorities reject her application and tell her that as a non-Luxembourgian national she should have sufficient resources for her stay. Please advise Michelle.
