Martha responds by email on May 2nd, "I accept but the fee for the audit seems low, would you consider $3,000?" DLA does not respond; however, on May 3rd, Dan, a CPA learns of the offer and faxes DLA, "I accept and will do the audit for $2,000." On May 6th, Martha emails DLA again and confirms that she will do their audit for $2,000. Who gets the contract in this case, Martha or Dan and why?
