General Duties of a Bankrupt and Bankrupt offenses: The following are a few of the important duties of a Bankrupt. Anyone who supplies inaccurate or misleading information or fails to meet these obligations during bankruptcy will be denied an automatic discharge. If anyone commits an offense under the Bankruptcy and Insolvency Act, either the trustee or creditors might object to your discharge.t 1. Delivering non-exempt assets to the bankruptcy trustee and disclosing all property (assets) in possession. 2. Handing over all credit cards to the trustee for cancellation; revealing all property (assets) in possession and surrendering non-exempt assets to the bankruptcy trustee. 3. Providing all forms, tax returns, insurance policies, and other papers requested by the bankruptcy trustee. 4. Not selling or giving away property bought on credit in the 12 months prior to applying for Bankruptcy. 5. Disclosing all details of the properties to the bankruptcy trustee. 6. Making all required payments, including surplus income; reporting family income and expenses to the trustee on a monthly basis. 7. Without court approval, not holding any positions such as company director in another company. 8. Attending two mandatory credit counseling sessions; attending any required creditors' meetings or Official Receiver examinations. Disqualification of a bankrupt: After the Bankruptcy order is given, the bankrupt is disqualified from; (a) serving as a trustee or representative in trust, estate, or settlement; (b). holding certain prominent positions in registered societies or other organizations. (c). practicing own profession or working in relatives' business d). being appointed to or functioning in the capacity of a public servant; (e). being elected to any public position in which the appointment is by-election; and (f). serving or voting as a member of any local authority, whether elected or appointed.
