As security, she offers her smart watch, valued at R40 000. Larry is willing, in principle, to accept the smart watch in pledge, but wants legal advice regarding the terms of the pledge agreement. Specifically, he seeks guidance on the terms/clauses that could strengthen his security position, as he is concerned that Barbara might default on the loan. Larry also wants to understand how he will be able to use the watch to mitigate any loss if Barbara fails to repay the loan. Required: Draft a detailed legal opinion in which you fully advise Larry on the key terms and protective clauses that can be included in the pledge agreement to strengthen his position as well as the procedures/remedies available to enforce the pledge in the event that Barbara defaults on the agreement.
