Edward set up a new printing shop in Wanchai. He ordered from Frankie three photocopying machines. It was stated in the contract that the three photocopying machines were to be delivered on 21 April 2006, the day on which the printing shop commenced business, and that time shall be of the essence. Frankie failed to deliver the photocopying machine on time. Edward was unable to enter into an unusually large contract in which he could earn a profit of HK$500,000.00. (25 marks) Please advise Edward and explain whether he could:

a. treat Frankie as having repudiated the contract; and

b. claim from Frankie the sum of HK$500,000.00.
