On 1st January 2021, Dato Charles had given his only son Harry, 4 travel buses (the properties) as gifts. Subsequently, Dato Charles had agreed to manage and collect monthly rentals of the properties and invest the proceeds derived therefrom for the sole benefit of the Harry. However, a year later Harry discovered that the rental monies were withdrawn from his bank account and used by Dato Charles for his own benefit. Harry then sought to recover from the properties and the rentals collected by Dato Charles from the properties. Dato Charles argued that it was a mere family arrangement. Advise.
