Robin is a chef in Jeffrey's kitchen, Central. He was hired from London as a pastry chef specialist. His employment contract contained the following prohibition. "Robin will not be permitted to work as a chef in Hong Kong within one year of leaving Jesse's Kitchen." Robin leaves and joins the Apple Occidental as a general chef. Jeffrey's kitchen brings an injunction preventing him from starting his job.

(2a)Advise Mrs. Chow in relation to terms used such as custody, care and control and access. [What are "custody, care and control and access"?] [15 marks]

(2b)Advise Mrs. Chow what factors the Court will consider in dispute of custody. [18 marks]

You are acting for Mrs. Chow in her divorce.Mr. and Mrs. Chow have been married for 10 years.They have three children; Betty who is 9 years old; Vincent who is 7 years old and Peter who is 5 years old.

Mr. Chow wants custody of all of the children. Mrs. Chow does not want this and advises you that Mr. Chow travels a lot with his job, so she does not feel that it would be in the best interests of the children to be with Mr. Chow on a full time basis. Mrs. Chow has been a full-time mother to all of the children.

Mrs. Chow seems a little confused about the terminology used and just wants the children to live with her.
