Ncube v Pienaar

A motor vehicle accident constructionist, appointed by you as Mary's legal representative, determines that each party had fault, attributjng 20% negligence to Mary, and 80% negligence to Mike. You proceeded to institute legal action against Mike kn Mary's instructions and so have a summons issued against Mike. Mike responds with a counterclaim to claim for the loss /damage he suffered.Attempts at settling the matter out of court prove unsuccessful and the matter is proceeding to trial as mike refuses to accept the 80% neglegence attributed to him. During the trial you plan on presenting photos of the accident and damage suffered (taken by Mary on her phone immediately after the accident). You have further contacted and confirmed with the motor vehicle accident constructionist to testify in court and have also been able to get two witnesses to testify in court in support of Mary's case.
