In the Marbury v Madison case, the Supreme court for the first time ruled that any law in conflict with the constitution is void. The ruling provided the supreme court with equal powers as the other two branches of the government. Also, the supreme court displayed its powers in regulating the execution of the constitution and the actions of the congress (Sabato, 2008). Concerning the Obama Care Act, the supreme court should exercise judicial review to ensure that although it has positive impacts the negative impacts are highly criticized. Some of the negative impacts include increased tax, increased premiums, individuals not insured by Obama Care being fined (Healthline.com, n.d.).

According to Jones, the Act should be judicially reviewed especially where it forces citizens to purchase health insurance or pay a fine (2013). Also, the increase in premiums for individuals with special medica conditions should be reviewed. Such an Act should ensure to include all individuals regardless of their ailments (Jones, 2013). Judicial review should also be exercised on the Nationwide Ban on Abortion Bill. Banning Nation Wide significantly affects pregnant women with devastating financial and medical conditions such as foetal anomaly and other medical treatments such as chemotherapy that are incompatible (National Partnership, 2018).
