You have asked me to determine whether East Carolina Insurance Inc. will need to report its recent ransomware event to the New York Department of Financial Services (NYFDS) under the New York Cybersecurity rules where no notification is required to any other supervisory body, and the event did not harm any part of its normal operations. Under the New York Cybersecurity rules, a covered entity must notify the NYDFS superintendent as promptly as possible, but in no event later than 72 hours from a determination that a cybersecurity has occurred that is either of the following: (1) an event impacting the covered entity of which notice is required to be provided to any government body, self-regulatory agency, or any other supervisory body, or (2) cybersecurity events that have a reasonable likelihood of materially harming any material part of the normal operations of the covered entity.
