e are fully aware of and will comply with the requirements of compliance and enforcement powers listed in part 6.4 of the Aged Care Act 1997, and with which our responsibilities to comply are outlined under Part 4.3, Division 63, Subdivision 63-1 (b).

These powers and our responsibilities apply to us as a prospective aged care provider seeking approval - meaning that the Commission has powers to search for and verify information relating to this application - and as an approved provider of aged care, which includes entry and search powers in relation to complaints or other potential non-compliances with our provider responsibilities and accountabilities, and in the course of regular assessment and reviews conducted by Aged Care Quality Assessors.

We acknowledge the authorised officer's power and will coordinate any required arrangements and actions in the following way:

  • Provide consent and do not hinder an authorised officer from entering our premises or exercising their search powers. In the event of such a requirement, the Managing Director or their delegate will provide consent, facilitate the conduct of entry and search activities, and communicate the requirement to cooperate with all relevant members of the workforce.
  • The Managing Director will ensure theHealth Care Manager, theHuman Resources Manager,the Finance & HR Manager, and theRisk and Health & Safety Manager stand ready to comply with and coordinate requests for information.
  • Facilitate access to property, facilities, people, records, or activities to uphold the search powers of the authorised officer.
  • Provide access to equipment to facilitate copying or saving of relevant documents.
  • Making staff members available to answer questions, demonstrate processes, or provide records or other evidence.
  • Provide access to relevant records or record-keeping systems.
  • Respond promptly to requests for information and provide evidence as required, within stated timeframes, during any monitoring activities, or during the investigation and resolution of external complaints or serious incidents.
  • Facilitate the allocation of staff to produce and coordinate information and documents and answer questions arising during monitoring and investigation activities.
