Easements by necessity are either granted to a buyer of a landlocked parcel, or reserved by a seller of land who retains a landlocked parcel after the separation and sale. There are 3 requirements to acquire an easement by necessity:

"a. Both the dominant and servient estates must have been owned by the same person before the need to access the dominant estate arose.

b. The need for an access easement was created by the subdivision of the commonly owned land.

c. The easement is necessary to use the dominant estate.""
