Rodolfo Constructions has entered into a contract with the State Rail Authority to build three railway stations along a new railroad line. The agreement provides that Rodolfo has to complete the work in 90 weeks. The common assumption is that the company will be able to work three eighthour shifts per day, six days a week. Three weeks after construction begins, Rodolfo Constructions is prevented, by way of an injunction, from working between 10pm and 6am and is not to work at all on Sundays. Rodolfo Constructions is no longer able to meet the deadline. Advise Rodolfo Constructions whether or not they should argue that the contract has been frustrated.
