Sam was driving through an intersection when Toby ran a red light and hit him. Sam, who was not wearing his seatbelt, was propelled through the windshield and landed on the pavement. Sam was rushed to the hospital and was treated for his injuries. Sam is planning on suing Toby for negligence. Sam already knows the Duty of Care and Breach elements of negligence that he must prove in court, and is confident that he will be able to do so, but is interested in whether he can claim for the following damages: the damage to his car (which was 'totaled'); his medical bills; and, the month of lost wages while he was recovering in the hospital.
