Question:
Section 107 (3) of the Industrial and Labour Relations Act, Cap 269 of the Laws of Zambia provides that; no employer or other person shall take part in a lockout and no employee, trade union or other person shall take part in a strike which is likely to hinder or interfere with the carrying on of any essential service, subsection (4) further provides that; no person engaged in an essential service shall be eligible for payment of his salary if such goes on strike or go-slow.
Proceed to analyse this provision in the light of the common place that the right to strike should be regarded as am aspect of human rights and that preventing workers to exercise this right could be interpreted as forced labour ?
