SECTION B: CASE SCENARIO (13 MARKS) Read the case and answer the question/issue in the case. In answering the case please use the IRAC method. Najwa has just started doing her Business Law assignment that has to be submitted by 5.30pm that day. Her printer's ink needs replacing but she does not think that she has time to go out to buy a new ink cartridge. She tells her housemate, Vithya, about her dilemma and Vithya offers to sell Najwa a cartridge for RM 95. Najwa refuses as she knows that she can buy a cartridge online for only RM 75. Vithya says, "Up to you then. Let me know if you change your mind. I will be back by 2 pm" and leaves to go to her class. Later, Najwa tries to print her assignment, but the printer runs out of ink. She calls Vithya but her mobile phone is turned off, so Najwa leaves a voice note saying, "Look, I'm desperate, so yes, I want the cartridge. But I can only pay RM80 for it". After she leaves the message, her neighbour Ling stops by her apartment to send the lunch that Najwa ordered earlier. When Ling hears of the problem, she offers to help print out the assignment on her printer. Najwa agrees and leaves a second voice note for Vithya telling her to ignore her previous message and she won't be needing the cartridge after all. Ling returns with the printed assignment, hands it over to Najwa who rushes out to her lecturer's office to submit the assignment. Meanwhile Vithya starts to listen to her messages when she comes out of her class, but her battery runs out before she can hear Najwa's second message. Vithya returns home to find that Najwa is still out, so she puts the cartridge in Najwa's room, with a note, 'You owe me RM80'. When Najwa returns home that evening, she saw the cartridge on her table and wants to return it to Vithya. Vithya however refuses to accept and insists that Najwa pay for the cartridge. Discuss whether there is a valid contract between Najwa and Vithya. (13 Marks)
