The main issue is looking at if management assigned overtime improperly to two employees on two different days. As the arbitrator, I would rule in the union's favor. I came to this conclusion becauseArthur and Duncan were both higher ranked than the overtime job that was posted, so with a small amount of guidance any other employee would have been able to complete the job. This means that management violated the union contract. Seniority and fairness are two major factors to look at when working in the union. With this being said, employees at the job level of the overtime should have been selected first.
