Lerato informs you that the 45 hours per week is not in accordance with her set agreement and that she will not be remunerated additionally for the 2 hours weekly. As you examine her contract, you notice that she only gets paid 112 of her normal rate for overtime worked, as per provision of the BCEA, but a collective agreement has been signed whereby employees will be paid 2x normal rate for all normal overtime. Advise her accordingly and make use of relevant case law to support your advice. You are the Human Resource Practitioner and your main role within the organisation is to resolve disputes before it needs external resolution, therefore your sole responsibility is to avoid disputes going to the CCMA or bargaining council.
