QUESTION $1$: Practical Activity: Lerato has a problem regarding her employment conditions Her contract states that she will work $43$ hours per week, however the new Human Resource Manager has called her in and informed her that her working hours have been amended in accordance with the BCEA, whereby she will now work $45$ hours per week. Lerato informs you that the $45$ hours per week is not in accordance with her set agreement and that she will not be remunerated additionally for the $2$ hours weekly. As you examine her contract, you notice that she only gets paid $1\frac{1}{2}$ of her normal rate for overtime worked, as per provision of the BCEA, but a collective agreement has been signed whereby employees will be paid $2x$ normal rate for all normal overtime. Advise her accordingly and make use of relevant case law to support your advice. You are the Human Resource Practitioner and your main role within the organisation is to resolve disputes before it needs external resolution, therefore your sole responsibility is to avoid disputes going to the CCMA or bargaining council.
