Let us say that your family has owned a nice piece of land with trees and grass outside a small town in New Mexico. Been on the property for generations, Great-Grandparents still live there. The land has a very thick (150 feet) layer of river gravels and sand just under the topsoil. Your Dad and his Dad used some of these gravels to build the ranch roads years ago. This gravel, if crushed to the proper size, would be perfect for building paved roads similar to the interstate highways. Your sitting on literally a fortune.

Now the problem. A highway construction company visited yesterday and served an eviction notice. They want the gravel for a major highway job and they claim they own the minerals (the gravel and sand). They have offered to move the family house, but that's about it.

All this time your family did not own the minerals under the land's surface. Its know as Split Estate in New Mexico. Within a city or village your protected from mining by the articles of incorporation I believe.

Every year it's proposed to the State Legislature that a law be passed requiring real estate agents to inform buyers that they are buying the land surface not the mineral estate.
