Case Brief #5: Situation in the Democratic Republic of the Congo in the Case of the Prosecutor v. Thomas Lubanga Dyilo (2007) and (2012), Text, pp. 539-550. This is the first case adjudicated by the International Criminal Court in the Hague, Netherlands, created under the Rome Treaty. Your brief should address the final judgment in 2012 that concludes the case. However, you are reading about the initial stages of the investigation, charge and trial in order to understand the procedure at the ICC that was developed in this historic first trial.

A Case Brief is one page to one and a half pages in outline form in which you describe briefly and precisely how the court addressed ALLof the following questions, giving only the most relevant information, based on the final judgment or decision of the court for the case assigned, referring to information in Week One onhow to brief a case:

1. What is the full name of the case, the name of the court, and the year date of the final decision by the court?
2. What are the most relevant "FACTS" of the parties to thecase the court needs to consider?
3. What is the single most important "ISSUE" for the courtto decide, identifying the question under international law?
4. What is the "HOLDING" of the court, identifying thecourt's answer under international law and the reason why the court reached this decision or judgement?
