Plaintiff Contentions The negligence of the dialysis nurse caused the infiltration. Defendants should have called paramedics rather than an ambulance. This caused delay in receiving emergency medical care giving her additional physical and psychological pain. She is now physically disabled as a result of the infiltration. She will not be able to work again and has severe traumatic stress disorder. Defendant Contentions Infiltration is a known risk of dialysis and occurs in the best of hands. The infiltration was recognized properly, and all treatment protocols were followed. Defendants provided proper medical care until plaintiff left the facility, including removing the needle and applying ice and pressure. Plaintiff's personal physician was called immediately and instructed defendants to call an ambulance, not paramedics to take plaintiff to hospital. Plaintiff was already on disability due to her chronic renal failure and was unable to work. According to defendants' neuropsychiatrist expert, plaintiff had adjustment disorder and narcissistic and histrionic personality traits.
