QUESTION 2 Mastura has a 2010 Harley Davidson motorcycle which was given to her as a birthday present 10 years ago. The motorcycle is very rare as it came with special edition components and parts and the current market value could reach RM150,000. At this time, she really needs money to pay for her housing loan as she was retrenched due to Covid-19 pandemic. She then decided to sell her 2010 Harley Davidson motorcycle and she knows a few friends who previously have been asking if she wants to sell the motorcycle to them. On 30 of June 2020 she calls Azura and offers to sell her 2010 Harley Davidson motorcycle for RM145,000. Azura says she needs to think about it and Mastura says she would keep the offer open until the 15 June. On the 6" Juno, Azura makes another call to Mastura and says she would buy it for RM130,000 and Mastura replies "impossible!". On the next day, Mastura sold the Harley Davidson to Nadiah. On the 14" June, Azura calls Mastura and she accepted Mastura's offer to sell the Harley Davidson for RM 145,000. Mastura says "bad luck dear, already sold". Azura then says that Mastura had promised to keep the offer open until the 15 June and therefore had breached her contractual obligations by selling it to Nadiah. ADVISE Mastura whether there is a legally binding contract between her and Azura. (15 Marks)
