While looking for find a new job, Michael Tam signs up to be a driver for a new ride sharing app called Follow, which advertises itself as a no-frills version of Uber. Follow Pty Ltd makes all drivers acknowledge they are acting as contractors and have their own ABN each time they log onto the app to take passengers. Drivers are free to start and finish whenever they like but Follow locks all drivers out of the app after 6 consecutive hours driving. Follow requires drivers to wear a Follow t-shirt and.attach a maqnetic logo to their car when carrying Follow passengers. Follow also requires all drivers to have a camera in their car that is focused on the driver to allow Follow to monitor its drivers. Follow doesn't stop drivers accepting other jobs from other ride sharing apps.

Tina was a passenger of Michael's and was injured at the end of a trip. Tina walked behind Michael's car to take her baq out of the trunk, but Michael forgot she had a bag in the trunk and drove away while she was taking her bag out, which caused her to fall and break her harm.Can Tina bring a claim against Michael, Follow Pty Ltd, or both for her injuries?
