You are a junior solicitor working in a small law firm that is developing a practice in Environmental Law.A local group called the Save the Spotted Grey Thrush wants to challenge a decision by the Commonwealth Minister for the Environment to permit fracking in a large national park area in New Soth Wales. They group has come to your firm for advice. They claim that fracking will destroy the habitat of the Grey Thrush and want to challenge the decision.

The legal partner of the firm has asked you to write memorandum of advice setting out factors the court will take into account when considering the question of standing both at common law and under the ADJR Act. In your memorandum of advice you should identify the information that will need to be gathered form the group to support the claim that they have standing to challenge the decision.
