TERM PAPER ON CONSTRUCTION CONTRACT COURT CASES

$$ Each student will write on two construction$-$related court cases, one of the cases will be assigned

by the instructor and the student will research to find the second case. The second case cannot be

a case that has been assigned to another student. Check posted list.

$$ The two cases should involve different contract issues; construction projects; a contractor and$/$or

project owner.

$$ For each case, research on the Internet and other sources, read the article and analyze the

situation in view of the subject matter and contract issues discussed in class.

$$ Write a paper, using double$-$spaced lines, one inch side margins throughout, with page

numbers, giving the following sections for each of the two court cases:

$(1)$ Provide the case number, if available, and title for each case

$(2)$ Indicate Parties involved $($Plaintiff$,$ defendant, Contractor, Owner, Designer, etc.$)$

$(3)$ Indicate Project Name, Type, Contract Amount, Location of project

$(4)$ Provide Date and Location of the case$/$court

$(5)$ Provide Brief summary of the case

$(6)$ Provide decisions at the Trial Court and Appeals Court and$/$or award given

$(7)$ Indicate expected further action$($s$)$ by the Parties, if specified

$(8)$ Commentary:

$($a$)$ Provide your opinion of the case.

$($b$)$ Define$/$describe$/$explain contract issues involved.

$($c$)$ Prior actions$/$arrangements$,$ the parties should have taken$/$made to settle the

case before it went to court.

$($d$)$ What could have been done by whom in the past $($or what could be done in the

future$)$ to avoid problems of this nature?

$$ Include all $8$ points as section headings in your paper, and use separate paragraphs for each point.

Complete one case and then start the second case on a new page.

$$ Include one Bibliography $($Reference$)$ section after the second case and two Appendix sections

after the Bibliography. Start the Bibliography and Appendix sections on a new page.

$$ Appendix should consist of copies of the case articles from your research$/$magazine$/$Internet$.$

$$ Organize your term paper to include Title page $($include paper title, course, instructor, department,

school, date, etc.$)$ and Table of Contents with page numbers.
