In March of 2022, an extraordinarily strong noxious odor flowed from the stove vent. Tess complained of this condition to Larry, but he refused to have it fixed. The odor continued, and it became so strong that Tess could not use the kitchen. Tess reported this to Ivan the city inspector, who fined Larry $1,000 for this new violation. Despite that, Larry failed to make the vent repair and the kitchen remained unusable. Tess remained in the home and stopped paying rent as of April 1st.
On December 1, 2022, Tess received a registered letter from Larry giving her notice to vacate the apartment on January 15, 2023. In a subsequent telephone call, Larry advised Tess that the notice was given because he was tired of Tess's demands for repairs and angry because of the additional fine he incurred.
