1. The Claimant is Red Mining (Pty) Ltd, is a company duly incorporated under the laws of Wakanda. Its head office is at 23 Olywenhout Street, Okoye, Wakanda. Red Mining is a mining company with several coal mines situated in Wakanda.
2. The contractual law of Wakanda is substantively identical to the Vienna Sales Convention on the International Sale of Goods (1980) (hereinafter referred to as the CISG). Wakanda is a member state of the CISG.
3. The contractual law of Valhalla is substantively identical to the UNIDROIT Principles on International Commercial Contracts (2006). Valhalla is party to the Rome I Regulation and the Brussels I Regulation as a member of the EU. Valhalla is not a member state of the CISG.
4. Both Valhalla and Wakanda have adopted the UNCITRAL Model Law (2006) and are party to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (1958).
