The restrictive covenants may be found void for either uncertainty or on the basis of public policy. In this particular case, it is not likely that an attack on the basis of uncertainty would succeed. The covenant is time limited, specically= and is intended to be effective against a very specic group of people. This group is readily ascertained as those born in Israel. The ground of attack of public policy is likely to be far much more successful. From the perspective of the 195Us this type of covenant may have been perfectly acceptable to the vast majority of Canadians, however in light of the public policy of the 21st century it is reprehensible.
