Short-Answer Question A

Imagine you're a consultant brought in to help a company build up its ethics program. You interview one manager, Lina, who says, "In all due respect, this whole ethics thing is silly. Our employees obey the law, that's all that we should expect."

Briefly state one argument that you could make in response. (Even if you agree with Lina, I want to make sure you understand the argument against this position.) Explain it in a brief answer of about 3-5 well-reasoned sentences.

In your own words, briefly describe ethical issue intensity, and discuss how it factors into ethical decision-making. Do so in about 3-5 well-reasoned sentences.

Short-Answer Question C

In Chapter 3, the textbook authors identify three "foundational values for identifying ethical issues." These are:

  • Integrity
  • Honesty
  • Fairness

They also identify many "ethical issues and dilemmas in business." These include:

  • Misuse of company time and resources
  • Abusive or intimidating behavior
  • Discrimination
  • Sexual harassment
  • Fraud
  • Consumer fraud
  • Financial misconduct
  • Insider trading
  • Intellectual privacy rights

Identify a pair between one item in the first list and one item in the second list. Briefly discuss how they are related. For instance, you could argue that intellectual property rights are a good topic to illustrate the value of honesty. (Don't actually make that pair, though; it's just to illustrate.)

Write an answer that shows that you genuinely understand both the value and the ethical issue.

In October, the Department of Justice sued Google, alleging anticompetitive behavior in violation of the Sherman Antitrust Act. The accompanying press release reads in part:

"Google has unlawfully maintained monopolies in search and search advertising by:

  • Entering into exclusivity agreements that forbid preinstallation of any competing search service.
  • Entering into tying and other arrangements that force preinstallation of its search applications in prime locations on mobile devices and make them undeletable, regardless of consumer preference.
  • Entering into long-term agreements with Apple that require Google to be the default and de facto exclusive general search engine on Apples popular Safari browser and other Apple search tools.
  • Generally using monopoly profits to buy preferential treatment for its search engine on devices, web browsers, and other search access points, creating a continuous and self-reinforcing cycle of monopolization.

"These and other anticompetitive practices harm competition and consumers, reducing the ability of innovative new companies to develop, compete, and discipline Googles behavior."

In some ways, this is a "standard" antitrust case. Yet in some ways, it shows a newer perspective that responds to the "potential concerns with [the] traditional framework" for antitrust that Professor Herman describes in his lecture on Chapter 4 (on February 22).
