The United States operates an Armed Services Recruiting Station in a one-story building in downtown Whoville. On September 11, 2013, several protestors climbed onto the roof, lowered the American flag flying over it, and burned it to symbolize their opposition to the war in Iraq.

Another group of protestors happened to live across the street from the recruiting station. On September 11, 2013 these protestors painted the outside of their home with anti-US slogans, staged a rally in the front yard of their home, and started a bonfire in their yard while burning copies of the Constitution.

Police arrived and arrested both groups of protestors. The first group was arrested on charges of trespass and damaging government property while the second group was charged with defacing property, unlawful assembly, and inciting to riot.

You are an attorney that has been hired to defend the Defendants. They all claim that their conduct was protected by the First Amendment.
