There are three issues in this case. First, did the inverse seniority replacement plan violate the NLRA. Second, if so$,$ was the strike an unfair labor practice $($ULP$)$ strike? And third, if it was an ULP strike, are the strikers entitled to reinstatement as of July $15?$ If the replacement plan violated the NLRA, it would be a section $8($a$)(1)$ violation so the first question is whether this plan interferes with, restrains, or coerces employees exercising their rights.
