Lab Law 241(6) requires owners and contractors to provide reasonable and adequate protection and safety for workers and to comply with the specific safety rules and regulations promulgated by the commissioner of the Department of Labor. The duty to comply with the commissioner's regulation is nondelegable. Thus, to the extent that a plaintiff asserts a viable claim 241(6), he need not show that the defendants exercised supervision or control over his worksite in order to establish his right of recovery.
