Is that valid? Why/why not

A Contractor has a CCDC2 contract with an Owner to build a 150 unit condo. The Contractor informs the Owner that the specified bathtubs have been discontinued by the manufacturer but a similar replacement is available for the same price. The Owner really likes the new tub (even better than the original) and readily agrees to the change. The Consultant and the Contractor sign the document below for the change.
