Timothy was a healthy and active nine-year-old boy. One Sunday, when out playing ball with his father, Timothy was struck by a car driven by a drunk driver. Timothy was initially unresponsive, but EMT's were able to stabilize him on the scene. Timothy was rushed to the hospital where he was placed on a ventilator. Timothy's parents remained by his side all through the night, however in the early morning hours on Monday, Timothy suffered a massive stroke. Timothy remained on the ventilator, but was pronounced brain dead by the neurologist. Despite having suffered whole brain death, Timothy's physical appearance was remarkably normal. When physicians alerted Timothy's parents to the fact that he had in fact been pronounced dead by brain death criteria, they adamantly protested removal of the ventilator stating that they were "not ready to let Timothy go" and that he "was not really dead since he was still being kept alive by the ventilator." Dr. Howard, Timothy's physician, was concerned about how to move forward. Dr. Howard recognized that while brain death is a legal ways to pronounce death in his state, he also knew that other states defer to families views about death and wondered if in this case it is appropriate for him to ex-tubate Timothy against his parent's wishes.
