QUESTION 2 (Contracts) On December 15, 2021, John Wild, President of Blake Corporation telephoned Walter Reach and offered to hire Walter to design a security system for Blake Corporations Research Department. Blake Corporation orally offered to pay Walter $240,000 spread over 24 months at a rate of $10,000 per month and stated the offer must be accepted in writing. In addition, acceptance must be received no later than 5:00 pm, December 24, 2021. On December 24, 2021, at 4:30 pm Hawaii-Aleutian Time, Walter Reach emailed John Wild at Johns Blake Corporation email address. Walters acceptance contained the following language: I accept your two hundred and forty thousand dollar ($2,400,000) offer. Weaver has been assigned $5,000 of my first month fee as payment for sums of money I owed Weaver. Payment of this $5,000 amount should be made directly to Weaver. On December 26, 2021, Blake sent a signed memo, via next day airmail, to Reach rejecting Reachs December 24th email but offering to hire Reach for a $130,000 fee. Reach responded in writing, accepting a 13-month contract at $10,000 per month to oversee the first 13 months of the design of the security system. However, Reach does not have the requisite license necessary for the security system design work. Blake Corporation does not honor the back-and-forth agreement. Walter Reach wants to sue Blake Corporation for breach of contract.
