What are your thoughts on this trademark article? The article I chose for this week's assignment finds us checking in on Nike. Just a few weeks ago, Nike was suing another company over improper trademark use in the "Satan Shoes" incident. Now Nike is being sued, believe it or not by the United States Postal Service for infringing on the USPS's marks in an upcoming shoe that's "inspired" by the postal service. What is interesting about this case is, Nike makes some of the same claims that MSCHF made justifying their case, but experts say Nike's claims are weaker than MSCHF's. The USPS in a statement said Nike's experimental Air Force 1 sneaker "is neither licensed nor otherwise authorized by the U.S. Postal Service This is an unfortunate situation where a large brand such as Nike, which aggressively protects its intellectual property, has chosen to leverage another brand for its gain." Strikes me funny that just three weeks ago Nike is circling the wagons and screaming foul that their marks were being used without permission and now they are on the other side of the table being accused of doing the exact same thing. Nike looks like they went beyond fair use of USPS marks and the USPS is wanting to protect their IP rights. The resolution to this case is going to be interesting, since it looked like the Nike vs. MSCHF case would become a landmark case and now this case could end up being the landmark case.
