The criminal justice system faces issues with classification issues for transgender individuals.My son works with our local police department and has encountered the issue on multiple occasions.Their issues arise in that some offenders present or identify as the opposite sex.While the initial contact with an offender does not propose as large a problem as it does should they have to be arrested.Herein lays the issues they have.While identifying as the opposite if they have not completed or even the started the process of transitioning where to they house the offender.If you place them with the male population, they may face violence by those that oppose their lifestyle while on the same token placing a male that has not transitioned in with the females the females may feel uncomfortable being housed with a male.
Some local jails have designated a specific unit that can house those that are identified in this manner so that they are not discriminated against and can be with others of the same beliefs.In doing this also allows the fellow inmates to be able to talk and peer counsel through the process.
Having these offenders housed together also allows for counselors to come in and have group sessions with them without having others that are against their choices involved so that they may speak freely without the worry of repercussions from fellow inmates later.
