While at a party hosted by a close friend, Cosmo ran into Larry, a loud-mouthed jerk who proceeded to ridicule Cosmo about his looks. After an hour of verbal abuse by Larry, Cosmo suddenly took a champagne bottle that was on a nearby table and struck Larry over the hea killing him instantly. At his arrest, Cosmo told the police that voices inside his head told him shut Larry up, permanently. Cosmo was tried in a jurisdiction that follows the Model Penal Code test for insanity. At trial, Cosmo's lawyer introduced psychiatric testimony indicating that Cosmo suffered from a mental illness. Cosmo most likely will be relieved of criminal responsibility if the defense can prove that: Crop Cosmo did not know that killing Larry was wrong, or he could not understand the nature and quality of his actions. Cosmo could not appreciate the criminality of killing Larry, or he could not conform his conduct to the requirements of the law. Cosmo was unable to control himself or conform his conduct to the law.
