Who is correct? Ms C, Ms T, and Ms E are childhood friends, studying law at Milpark Business School. They discuss the new Protection of Personal Information Act, 2013 (POPIA). They all agree that POPIA promotes the protection of personal information processed by public and private bodies. They further agree that it was necessary to introduce certain conditions so as to establish minimum requirements for the processing of personal information of South African citizens. Ms C and Ms E also agree that the President, Cyril Ramaphosa, drafted POPIA and gave effect to it. Ms T argues that citizens have a constitutional right to make the law and give effect to it. They approached you, their lecturer, as they need clarification on how legislation is effected in South Africa.
