Workforce members should be aware that under the Privacy Rule an individual has the right to request copies of his or her health records. The provider may deny the patient access:

Under limited circumstances that must be communicated in writing to the patient

In all circumstances, as long as they are communicated in writing to the patient

When the patient refuses to pay for the copies of the records

If the patient refuses to accept a summary of the records rather than the actual records
