Facts:
Your friend, John Busyhead, had been doing a vast amount of yard work to get his lawn in tip top shape as spring arrives but then he was injured in a car accident and broke his leg. As a consequence, he has a large pile of yard waste he would like to be removed. Further, he is unable to take care of his lawn this spring. While at a doctor's appointment, he ran into Jack Bryan. Jack has a yard service business. Jack has agreed to remove the yard waste and maintain John's lawn by mowing, edging, weeding and fertilizing each month beginning April 1, 2023 through September 30, 2023. John will pay $400 per month. Any late payments are subject to a $50 late fee (assume this is reaonable under the law). John agrees to make an deposit payment of $400 per month on or before March 15, 2023 (which will be applied to the last month's payment). Jack agreed to remove the yard waste by April 10, 2023. John wants a clause in the contract that if the yard waste is not removed by April 10, 2023, he can recover all monies paid (including the deposit payment). Jack wants a clause in the contract that if John does not make the monthly payment, Jack may cease all work and will be able to retain the deposit payment. The parties agree that Oklahoma law will apply. The parties also want a contract provision that in the event of some natural disaster, etc., performance pursuant to the contract is excused.
