However, the three main steps when determining if this decision was ethical or taken too far are if there was discretion, duty to enforce the law, and duty to uphold constitutional protections. Due to how the situation was handled with Officer Turek and Gail Atwater, I believe the steps taken were not necessary and were taken too far. Understandably, Officer Turek may have only intended to scare Miss Atwater with the dangers of not wearing a seatbelt, not only for herself but for her children as well. As the children were very young, one being a three-year-old son and the other being a five-year-old daughter, it could have ended very badly if Miss Atwater had gotten into an accident, which is why I can understand the severity of the case, which is why I would give leisure in understanding Officer Turek's reasoning. However, in this case it just didn't seem as if Officer Turek was genuinely concerned with the safety of the children and wanted to merely just abuse his power. An example of this
