The plaintiff Kemper sat in Section 101 on the lower level of Hannigan Stadium with her daughter and her son, both minors and not parties to this action. Another patron at Hannigan Stadium, Dan Kolleng, sat four rows behind Kemper with three companions. During the seventh inning "stretch," the period between the seventh and eighth innings of play during which time patrons sing the popular song "Take Me Out to the Ball Game," Kolleng propelled a souvenir bat in the direction of Kemper. The bat struck Kemper in the back of the head as she was standing to sing "Take Me Out to the Ball Game," causing her to fall forward. Kemper struck her shoulder on the back of the seat directly in front of her. Kemper was taken to Southeastern Medical Center, received four stitches in the back of her head, and was treated for a concussion and a broken collarbone. The incident was due to the negligence of the defendant Cubs, including but not limited to failing to properly train staff members selling alcohol on detecting and refusing to sell alcohol to intoxicated patrons, failing to supervise alcohol vendors distributing beer and spirits to patrons throughout the stadium, failing to implement adequate measures for removing intoxicated fans, failing to adequately staff Hannigan Stadium to detect and remove intoxicated fans, failing to reprimand vendors whose improper distribution of alcohol had previously led to violence and/or inappropriate behavior by intoxicated patrons, negligent hiring, training, and supervision of Security and employees, and failing to prevent and/or guard against reasonably foreseeable harm to patrons of Hannigan Stadium. As a direct and proximate result of the incident, the plaintiff Kemper suffered bodily injuries that have caused, and will continue to cause, physical and mental pain and suffering for the rest of Kemper's life. The plaintiff Kemper has incurred, and will continue to incur medical, therapeutic, and related expenses. Moreover, the plaintiff suffered a loss of earnings and an inability to enjoy the normal functions of life.
