YOUR ASSIGNMENT ONE PROBLEM:
You are working for a start-up company called Privacy, Inc., based in Ypsilanti, Michigan. Privacy, Inc., is a company dedicated to protecting privacy of its clients who need or want heightened privacy. You have been asked to research and propose wording for Privacy, Inc. terms (or conditions) of use for their website as well as their general terms of service. (For the purposes of our assignment, this is a fictitious company, and I do not mean to reference any real or actual company).
Your supervisor suggests that you review the terms of service, jurisdiction language and choice of law provisions from some of the major companies such as FaceBook, Apple, and others you may choose. *Remember, the main focus of this paper/assignment is on jurisdictional language, in additional to anything else called for.*
Your task is to:
1) Choose three companies, who have a strong Internet presence or business model. Then review their terms and conditions, with a special emphasis on jurisdictional language, venue, choice of law, and privacy related concerns for your clients.
2) Evaluate and compare the wording from these three online retailers and describe how they are helpful or not helpful to the customers they serve and how certain language from each may be helpful or not helpful to the customers that Privacy, Inc. will serve, should you adopt that language. Focus on jurisdictional language, venue and choice of law, including personal jurisdiction provisions.
3) Evaluate and compare the wording from these three online retailers and describe how they are helpful or not helpful to the businesses themselves and how certain language from each may be helpful or not helpful to the business of Privacy, Inc. , should you adopt that language. Focus on jurisdictional language, venue and choice of law, including personal jurisdiction provisions.
4) Make a recommendation to your employer as to the specific jurisdictional language, venue, choice of law provisions and similar, that you recommend to be included in the terms of use. Detail out the exact jurisdictional language you are proposing, word for word, being very explicit as to exactly what you are proposing. Please place the language, word for word, in quotation marks. Explain why you included the elements you recommend, and why your recommendations support a legal and economically viable policy.
5) I would expect a well-developed paper to include portions of the language being compared either within the body of the assignment, or in an Appendix attached to your paper.
6) Use headings in your paper to clearly identify that you have included the required information, and make the various information easy to locate.
*Remember, the main focus is on the jurisdictional language for each company looked at, and for your own specific, detailed, exact, word for word language you are proposing for our fictitious company.*
