When the fraternity gave its party at the University of Arizona, no court in that state had ruled that a fraternity could be liable for a drunken student’s auto accident. Isn’t it unfair to impose this liability retroactively on the fraternity? Couldn’t the court rule that in future cases a fraternity would be found liable?
