We agree. Here, the trial court denied Jarrell’s motion under the misapprehension that it lacked the necessary jurisdiction to declare the adoption decree void. This constituted an abuse of discretion by a failure to exercise the discretion conferred by law and we vacate the trial court’s .order. In order to expedite resolution of this matter in the best interest of the minor involved, we next address defendant’s second argument: whether the adoption decree was in fact void.
